I am seeking an Australian paralegal, senior law student or recent law graduate with extensive experience using Australian legal research databases to conduct targeted case law research. You should have advanced legal research database search skills. Access to proprietary legal databases is an advantage. This task is to identify Australian tribunal and court decisions involving: • unauthorised disclosure of health or sensitive personal information • breaches of health privacy or confidentiality by health practitioners • disclosures justified (or unsuccessfully justified) on grounds such as duty of care, risk, safety, or welfare The objective is to understand the key factors relied upon by tribunals and courts, how compensation (if any) has been assessed, and what quantum ranges have been awarded in comparable matters. While one relevant jurisdiction involves Victoria and health privacy legislation, the research must not be limited to that jurisdiction. The search should also cover comparable Acts, tribunals, and courts in other Australian jurisdictions. The value of this task lies in identifying analogous reasoning and outcomes, including where the statutory framework differs but similar privacy and confidentiality principles are applied. While searching can be an open-ended task, I would like to time-limit the search, including preparation of a concise summary of findings, to 3 hours.
