NCAT Appeal – Strata Matter (Lawyer Needed) We're seeking a lawyer with NCAT experience to review our written submissions and appeal documents in a strata dispute. We’ve self-represented to date but now require legal advice – and possibly representation – ahead of a final appeal hearing. The appeal is based on: Error of law: Tribunal failed to consider s232 of the Strata Schemes Management Act when dismissing our standing. Procedural unfairness: The Respondents introduced a new legal argument (s132) less than 48 hours before the hearing, which the Tribunal relied upon without giving us a chance to respond. Need some consultation regarding debt recovery! So here’s full story In December 2024, I transferred a total of $3,500 to an individual named Mr X . The money was sent in two parts: $1,500 on 14 December 2024 and $2,000 on 31 December 2024. These transfers were made through my bank, and I have transaction records. The funds were intended as a personal loan, with the expectation of repayment. There was no formal written agreement, but I do have messages referencing the loan and a repayment request. The person is now refusing to repay the money and is attempting to frame the transaction as a shared gambling arrangement, claiming the money was voluntarily provided for joint betting and therefore non-recoverable. I have attached screenshots of relevant conversations which suggest I asked for repayment and they acknowledged the amount I was requesting. They are now denying the debt and making counterclaims that I acted unfairly or harassed them. They also allege a verbal agreement took place in May 2025 to waive the debt, which I dispute. I would like to know: 1. Whether I have a valid claim to recover the loan through NSW courts or NCAT. 2. Whether the other party’s gambling argument significantly weakens my case. 3. Hello 👋 I want to know if my lawyers are scamming me for their own benefits! Here’s what happen, we received a letter from our neighbours about a boundary dispute , the lawyer told me to show me our plans and date of when the house we built so we did ! Then he said I can do this case ! We get them with adverse possession!! I asked him how much would everything cost he said 15K and wanted 5000 plus 440 for booking fee , so which we paid and agreed on . Our lawyers and there lawyers were emailing back and forth about this adverse possession claim ! They said we can’t use it and explained why and my lawyers said they are talking shit we can use this ! 25k letter it was ready to go to court and on the day before court we had a interview with a barrister and he said we can use it ?????? I was blow away ! We just paid 20 grand to our lawyers for this ! Wouldn’t our lawyers seek advise first or know about this before we went for it ?? Now they are asking 5k for a letter of demand so total 30K double the amount we been told when we first started and they now told me We have to pay them The other party ??? Are my lawyers scamming me ? Coz this is putting me in a situation now where I’m now down 30k and don’t have more money for the lawyers or anything ??
