I want to lodge a complaint before AFCA relating to an insurance claim arising from hail storm damage to my property in Queensland. I have spent a considerable amount of time reviewing the AFCA Rules, AFCA processes, the General Insurance Code of Practice, and the documentation relating to my claim. However, I am struggling to understand how AFCA approaches disputes in practice, what evidence carries the most weight, how submissions should be structured, and how to most effectively present my case. I am looking for someone who has either: • Successfully navigated an AFCA insurance complaint as a consumer; or • Previously worked at AFCA; or • Has significant experience dealing with AFCA insurance disputes. I am not seeking legal representation or someone to prepare the submission for me. Rather, I am looking for guidance and mentoring to help me understand: • What AFCA actually considers when assessing an insurance dispute; • What evidence is most persuasive; • How AFCA weighs competing expert reports; • How detailed my submission should be; • What issues are worth focusing on and what issues are likely to be irrelevant; • Common mistakes consumers make when presenting their case; and • How I can best prepare my submission and supporting material. The dispute involves issues relating to storm/cyclone damage, water ingress, mould, building assessments, scope of works, and the insurer's handling of the claim. I would like to have an initial discussion (max 30 minutes), ask a number of questions, and obtain practical guidance from someone with direct AFCA experience.
