I’m seeking an experienced employment lawyer, ideally with knowledge of the allied health sector or professional services, to review and update our existing Contractor Service Agreement. The goal is to ensure our agreement aligns with a practice management model and is fully compliant with ATO, superannuation, and GST requirements. Context: I operate a growing psychology practice that engages contractors with ABNs. These contractors provide services to their own clients, and in return, I offer practice management support including consulting rooms, administration, and client referrals, in exchange for a fixed service fee. Our accountant has raised concerns that our current agreement could incorrectly imply that the business earns the client income and pays contractors, which may trigger unwanted obligations for superannuation and GST. A newly engaged contractor has also questioned the setup after speaking with their accountant. Current model: * Fixed session-based fees (not percentage split) * Schedule of fees is GST-inclusive * We issue fortnightly RCTIs, including GST if applicable * Contractors manage their own BAS and claim GST credits What I need: * Review of the current Service Agreement * Clear redrafting to reflect that income belongs to the contractor and is held in trust * Define a fixed service fee deducted for admin/room use * State that contractors handle their own tax, super, and insurance * Advice on continuing RCTI structure * A short clause or letter to send to existing contractors outlining the changes * Guidance on managing a current contractor’s concerns * Operational or invoicing recommendations to support compliance Also open to advice on whether to continue with a Contractor Agreement or shift to a Services and Facilities Agreement, now that we provide physical consulting rooms. Employment Lawyer with Tax Law Knowledge – Review Contractor Agreement, RCTI Process & Provide Letter Description: I'm looking for a registered employment lawyer with expertise in tax law and GST compliance, preferably with experience in allied health contracting, to review a signed Service Agreement and our use of Recipient Created Tax Invoices (RCTIs). Background: I run a psychology practice in Melbourne and have engaged a contractor with their own ABN. Instead of a percentage split, we pay a fixed fee per session (GST-inclusive). We issue fortnightly RCTIs, which include GST if the contractor is registered, allowing them to claim GST credits via their BAS. The contractor has now advised, based on their accountant’s advice, that they must issue invoices with 10% GST added on top of our agreed fee—arguing that our RCTI process is not compliant. They reference other arrangements they have elsewhere, which may be influencing their stance. My questions: 1. Is our current RCTI and fixed-fee process ATO compliant or not complying with tax law? 2. Further to above, has something changed legally, do we need to tighten our Service Agreement or processes? 3. How should we respond if they refuse the RCTI process? What I need: 1. Review of the signed Service Agreement and RCTI template (provided upon engagement) 2. Legal advice confirming whether our RCTI and payment process is compliant with tax law 3. Guidance on how to professionally respond. If compliant with tax law, provide a clear letter to the contractor outlining their obligations and that separate invoices are not required if issued compliant RCTIs. 4. If not compliant with tax law, advice on whether our Service Agreement needs changes to better reflect a compliant contractor model and any system/process updates to support this Please only respond if you're a qualified legal professional with relevant experience in employment and tax law within the allied health context. 🙏

I believe that the only way that I can successfully ensure that my siblings gain access to my superannuation fund in the event of my death is to create a Will which basically will state that my siblings are entitled to my superannuation fund via a binding death nomination form from my superannuation fund.
