He acted on the advise which was that there was weak but legit grounds to teminte the cintract based on the form 2 disclosure being incomplete. He sent the notice to terminate and no response from sellers solicitors. Settlement is on Thursday. He is concerned that: he won't be able to even settle on the sale now if he still chooses to: they may dispute the return of deposit and argue he terminated on false grounds and therefire be liable for full expenses. He was hoping the request to terminate would facilitate a reduction in the contract price. He is still interested to keep the purchase property as well as terminate.
