Airtasker New Zealand Customer Membership Terms & Conditions

These Airtasker New Zealand Customer Membership Terms & Conditions (Membership Terms) are between you and Airtasker New Zealand Limited (NZBN 9429 048 413 565) (Airtasker). These Terms govern the purchase, renewal and use of an individual customer Airtasker NZ Membership (defined below). By purchasing, renewing, or using an Airtasker NZ Membership, you agree to these Membership Terms and any use of the Platform is also subject to Airtasker's Website Terms and Conditions available at www.airtasker.com/nz/terms (collectively, the Terms).

1. About the Membership

  • 1.1 An Airtasker NZ membership is a paid membership program that entitles the individual account holder (Member) to assign tasks on the Airtasker New Zealand platform www.airtasker.com/nz (Platform) without having to pay an associated Connection Fee (Airtasker NZ Membership).
  • 1.2 During an active Membership Period, Members receive NZ$0 Connection Fees on all tasks booked through the Airtasker New Zealand Platform (Membership Benefits), subject to fair use and these Membership Terms.

2. Membership Fees and Term

  • 2.1 An Airtasker NZ Membership costs NZ$89 annually (Membership Fee).
  • 2.2 The full cost of the annual Airtasker NZ Membership is due at the time of purchase.
  • 2.3 An Airtasker NZ Membership is valid for 12 months commencing from the date of purchase (Membership Period).
  • 2.4 At the end of the Membership Period, the Airtasker NZ Membership will automatically renew for a successive 12-month period (being a new Membership Period) unless the Airtasker NZ Membership is terminated prior to the renewal date, in accordance with these Membership Terms (in particular, the minimum notice required in clause 4.1).
  • 2.5 By purchasing an Airtasker NZ Membership, you authorise Airtasker to automatically charge your nominated payment method for the annual fee and each renewal at the then-current Airtasker NZ Membership annual price.
  • 2.6 You are responsible for ensuring your payment details remain accurate and up to date. A failed or declined payment does not relieve you of your obligation to pay.
  • 2.7 From time to time, we may offer different membership programs, and the fees and terms for those different memberships may vary. You will find details about the membership model you are subscribed to, the applicable membership fee and the next due date in your account.

3. Payments

  • 3.1 An Airtasker NZ Membership can be purchased by any individual with an active Airtasker New Zealand user account who is aged 18 years or over.
  • 3.2 To purchase an Airtasker NZ Membership, you must visit the Airtasker Membership Landing Page and follow the steps to purchase.
  • 3.3 Airtasker NZ Memberships cannot be purchased using gift cards, Airtasker credits, vouchers, or coupon codes.
  • 3.4 Airtasker NZ Memberships can only be purchased by the individual account holder who will be the Member. Airtasker NZ Memberships can not be purchased for any other individual or account.
  • 3.5 Airtasker NZ Memberships are for individuals only and are not currently available to businesses.
  • 3.6 Airtasker NZ Memberships cannot be purchased through the Airtasker mobile application and must be purchased via the Airtasker website.

4. Cancellation by You and Refunds

  • 4.1 You may cancel your Airtasker NZ Membership at any time by contacting Airtasker's customer service team at least 7 days prior to your Airtasker NZ Membership renewal date.
  • 4.2 Cancelling your Airtasker NZ Membership means that your Airtasker NZ Membership will not automatically renew at the end of the Membership Period. You will keep your Membership Benefits for the remainder of the Membership Period you have already paid for. Cancellation does not of itself entitle you to a credit, refund or exchange for the unused part of that Membership Period.
  • 4.3 To the maximum extent permitted by law, Airtasker NZ Memberships have no cooling-off period, and Membership Fees are non-refundable on a change of mind. This may include circumstances where the Airtasker NZ Membership is partially used or completely unused, or where the Member account has been restricted or deactivated for misuse or deleted on request of the Member.
  • 4.4 Clauses 4.2 and 4.3 are subject to clause 8.4 (refund if Airtasker discontinues the Airtasker NZ Membership program) and clause 9.4 (your rights under the Consumer Guarantees Act 1993 (NZ) and the Fair Trading Act 1986 (NZ), which are not affected by these Membership Terms).

5. Fair Use

  • 5.1 The Membership Benefit during an active Membership Period, entitles Members to receive NZ$0 Connection Fees on all tasks booked through the Airtasker New Zealand platform.
  • 5.2 Airtasker NZ Memberships are for individual use only and are subject to fair use. Airtasker may impose reasonable limits, monitoring, or restrictions to prevent use outside of fair use, which may include, but are not limited to, the following:
    • 5.2.1 Excessive, repetitive, or abusive booking behaviour.
    • 5.2.2 Sharing access to or use of an Airtasker Member account between other users or by businesses.
    • 5.2.3 Behaviour that Airtasker determines to be fraudulent, exploitative or otherwise outside of ordinary individual customer use.
    • 5.2.4 Booking patterns inconsistent with individual consumer use, for example, commercial volumes.
  • 5.3 If Airtasker determines fair use has been abused, it may warn you and require cessation, temporarily restrict your Membership Benefits, or suspend or terminate your membership and account without refund.

6. Account Use and Non-Transferability

  • 6.1 Airtasker NZ Memberships are non-transferable and may only be used by the individual Airtasker account holder.
  • 6.2 You must not share your account credentials or allow any third party to access or use your Airtasker NZ Membership.
  • 6.3 Any attempt to transfer, share, or misuse an Airtasker NZ Membership may result in immediate restriction, suspension, or termination of the account without any refund.

7. Suspension and Termination

  • 7.1 If Airtasker reasonably determines that you have breached these Membership Terms or Airtasker's Website Terms & Conditions, Airtasker may immediately restrict, suspend, or terminate your Airtasker NZ Membership or Airtasker account.
  • 7.2 In the event that your Airtasker account is restricted, suspended, or terminated for breaching Airtasker's Website Terms and Conditions or Community Guidelines, you will not be entitled to any refund, credit, or compensation.
  • 7.3 Airtasker reserves the right to accept or refuse any attempts to purchase or use an Airtasker NZ Membership, to the extent permitted by applicable law.

8. Changes to the Membership

  • 8.1 Airtasker may, in its reasonable discretion, change these Membership Terms, the Membership Benefits, discontinue the Membership program or modify its pricing. Any changes implemented by Airtasker will not affect your right to cancel your auto-renewal at any time. Where we make material changes to these Membership Terms or the Membership Benefits, we will provide you with at least 30 days prior written notice via email to the address associated with your account. If you do not agree to the change, you may cancel before it takes effect (see clause 4). Clause 8.4 applies if Airtasker discontinues the Airtasker NZ Membership program.
  • 8.2 If any change to these Membership Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.
  • 8.3 Continued use of a Membership after changes take effect constitutes acceptance of the updated Membership Terms.
  • 8.4 If Airtasker discontinues the Airtasker NZ Membership program during a Membership Period for which you have paid, Airtasker will refund the unused portion of your Membership Fee, calculated on a pro-rata daily basis from the date the program ends. This clause does not limit any other refund Airtasker may provide, or your rights under clause 9.4.

9. Disclaimers and Liability

  • 9.1 Holding an Airtasker NZ Membership does not guarantee Tasker availability, pricing, or service outcomes. It merely provides the member with the Membership Benefits.
  • 9.2 Pursuant to Airtasker's Terms and Conditions, you specifically acknowledge and agree that any services provided to you in relation to a Task you post on the Platform will be the services of an independent contractor engaged by you. To the extent permitted by law, Airtasker is not liable for any loss arising out of or in any way connected with the services provided to you by an independent contractor in relation to any Task.
  • 9.3 Except in relation to any guarantee, right or remedy that cannot be excluded or limited under the Consumer Guarantees Act 1993 (NZ), the Fair Trading Act 1986 (NZ) or any other applicable law, and to the extent permitted by law:
    • 9.3.1 Airtasker is not liable for any indirect or consequential loss arising out of your Airtasker NZ Membership; and
    • 9.3.2 Airtasker's total liability to you arising out of your Airtasker NZ Membership is limited to the Membership Fees you have paid in the 12 months before the event giving rise to the liability, or NZ$50, whichever is greater.
  • 9.4 Nothing in these Membership Terms excludes, restricts or modifies the application of the Consumer Guarantees Act 1993 (NZ), the Fair Trading Act 1986 (NZ), or any other right or remedy that cannot be excluded or limited under applicable law.

10. Privacy

  • 10.1 Personal information collected in connection with your Airtasker NZ Membership is handled in accordance with Airtasker's Privacy Policy.

11. General

  • 11.1 Airtasker NZ Memberships cannot be used in conjunction with other offers unless expressly stated.
  • 11.2 To the extent permitted by law, Airtasker makes no additional warranties, express or implied, with respect to Airtasker NZ Memberships beyond those required by law.
  • 11.3 In the event of any inconsistency between Airtasker's Terms & Conditions and these Membership Terms, these Membership Terms will prevail in relation to the Airtasker NZ Membership.

12. Governing Law

  • 12.1 These Membership Terms are governed by the laws of New Zealand. By purchasing an Airtasker NZ Membership, you submit to the exclusive jurisdiction of the courts of New Zealand.
